I think that DirectAdmin doesn't use apache.
I can't think in a way to use another php.ini
Softaculous use php, by default php.ini, apache (or cgi requests) use same file and i need add ionCube to php.ini. I mean how to say softaculouse to use another php.ini file (with ionCube) and let apache or default php request load php.ini without ioncube

yes, fopen is off then. Please enable it and after install you may disable it.
As I said with APACHE its wossible to give directories different PHP.ini but you will need to consult Direct Admin on this.

We have SOftaculous running on nearly 300 of direct admin servers so I guess its production ready.

I ran the install using this guide http://www.softaculous.com/docs/install_direct_admin
It didn't make the directory during install and displayed error can't chmod /var/softaculous file or directory not found. Same with chown
Everything installed fine and I added the dir myself and updates the programs.
Running Centos 5.2 32 bit
As I said the directory was not made during install.
I ran the install using this guide http://www.softaculous.com/docs/install_direct_admin

Is the mkdir function enabled in your PHP CLI ?
Sir first use wget to download the file.

I have changed nothing on the dirctadmin install no to jailed during install if that helps.
I have no idea how to check if mkdir is enabled, I understand it is default enabled so I have no idea.

mkdir should be able to make the directory as you were running as root as well.
